Terms of Service — Blue Noise

1. Acceptance of Terms

By accessing or using the Blue Noise website (bluenoise.ai) or engaging our services, you agree to be bound by these Terms of Service. If you do not agree, please do not use the site or services.

2. Services

Blue Noise provides marketing strategy, AI-powered automation, Arabic-first campaigns, PR, lead generation and CMO mentoring services across the MENA region. The scope, deliverables, fees and timelines of any engagement will be defined in a separate written agreement or Statement of Work (SOW).

3. Use of the Website

You agree to use the website lawfully and not to: (a) attempt to gain unauthorized access to any part of the site; (b) interfere with the operation of the site; (c) scrape, copy or republish content without written permission; (d) misrepresent your identity when contacting us.

4. Intellectual Property

All content on this site — including text, graphics, logos, articles, case studies, frameworks and the Blue Noise name and brand — is owned by Blue Noise or its licensors and is protected by applicable copyright and trademark laws. No license is granted to use any of this material without our prior written consent.

5. Client Content & Confidentiality

Materials, data and information provided by clients remain the property of the client. Both parties agree to keep confidential information shared during an engagement protected and to use it solely for the purpose of delivering the agreed services.

6. Fees & Payment

Fees, retainers and payment terms are set out in the relevant SOW. Unless otherwise stated, invoices are payable within 14 days. Late payments may be subject to suspension of services.

7. Disclaimers

The website and any general information provided are offered "as is" without warranties of any kind. Marketing results depend on many factors outside our control, and Blue Noise does not guarantee specific business outcomes, rankings, conversions or revenue.

8. Limitation of Liability

To the fullest extent permitted by law, Blue Noise shall not be liable for any indirect, incidental, special or consequential damages arising from the use of the website or services. Our total liability under any engagement shall not exceed the fees paid by the client in the three (3) months preceding the claim.

9. Third-Party Links & Tools

The site or our services may reference or integrate third-party platforms (e.g. analytics, ad platforms, CRMs). We are not responsible for the content, policies or availability of such third parties.

10. Termination

We may suspend or terminate access to the website at any time for any reason. Termination of client engagements is governed by the relevant SOW.

11. Governing Law

These Terms are governed by the laws of the United Arab Emirates. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Dubai, UAE.

12. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above reflects the latest revision. Continued use of the website after changes constitutes acceptance of the revised Terms.
